GLASGOW HERALD
24 OCTOBER 1883

COURT OF SESSION
ROBERT BRYCE v. THE SHIP FALLS OF CLYDE COMPANY (LIMITED) AND OTHERS

Some time ago the pursuer, who resides at Bayview Cottage, Saltcoats, brought an action to have it declared that certain shares in the Falls of Clyde belonging to his son, formerly master of the FALLS OF AFTON, had been transferred to him, and that he was entitled to the profits arising upon these shares.

Defenders resisted the action, and stated that in July 1882, an action had been raised by the owners of the FALLS OF AFTON against Thomas Bryce, son of the pursuer here, for £2779, as the damage sustained by them through the wrongful abandonment of that ship, and that with the object of defeating pursuers in that action, the bill of sale of the shares had been effected.

Today intimation was made that both actions had been settled.

In the first case the father obtains declaratory as asked for, and in the second case the son has been assoilzied, in terms of a joint minute.

DEAD WOMEN – MAN IN COURT TODAY

A man will appear in court at Kilmarnock, Ayrshire, today in connection with the deaths at the week-end of two women.

The women, whom police yesterday still refused to identify, were found in the back bedroom of a ground floor two-roomed flat at 1 Hirst Place, Saltcoats, on Saturday.

Detectives broke into the house. Shortly afterwards they said a man was in custody.

It is believed the victims were Mrs Peggy Cantwell, aged 44, of 15 Cochrane Street, Paisley, and her sister, Mrs Susan Cochrane, of Leicester, who had been staying with Mrs Cantwell on holiday.

MAN CHARGED WITH DOUBLE MURDER

JAMES FIDDES, (42), appeared at a High Court pleading diet at Kilmarnock yesterday charged with the murder of his two sisters.

The charge read: -

“You are indicted that you did on July 16, 1966, in the house occupied by you at 1 Hirst Place, Saltcoats, assault your sisters, Susan Fiddes or Cochrane, aged 49, 8 Quebec Road, Leicester, and Margaret Fiddes or Cantwell, aged 45, 15 Cochrane Street, Paisley, and did discharge a loaded shotgun at them and shoot them, and you did murder them.”

An agent for Fiddes tendered a plea of guilty to culpably homicide.

The case was adjourned to a sitting of the High Court in Ayr on October 25.

PROSECUTOR TELLS OF SHOTGUN AT PARTY BEFORE SHOOTING

Ayr High Court with Lord Hunter presiding, yesterday heard of a drinking party in a house at Saltcoats, Ayrshire, at which a shotgun was shown to guests. A few hours later two middle-aged sisters were found dead in the house.

Before the court was JAMES FIDDES, (42), 1 Hirst Place, Saltcoats.

Mr. R. C. MacArthur, Advocate, defending, tendered a plea of guilty to culpable homicide and this was accepted by Mr. Donald Macaulay, Advocate-depute, prosecuting, because of medical reports.

The two sisters, Susan Fiddes or Cochrane, 8 Quebec Road, Leicester, and Margaret Fiddes or Cantwell, 15 Cochrane Street, Paisley, were found dead in the house at 1 Hirst Place on July 16.

ILL-FEELING

Mr. Macaulay told the Court that since the accused’s mother’s death in June there had been ill-feeling between Fiddes and his sisters regarding the mother’s estate – the house and £450.

“On the night before the sisters died he had been in their company. They had been drinking.”

After that there was a party at the house which was attended by neighbours. More drink was taken, Mr. Macaulay said. Fiddes was in high spirits and there had been no sign of ill-feeling.

Fiddes danced with one of the sisters. The party broke up about 2 a.m. He was next seen at a neighbour’s house at about 4 a.m. and he indicated he had been locked out of his house.

At 8.50 a.m. the daughter of Mrs. Cochrane received a telephone call from Fiddes. He told his niece that his sisters had been in Saltcoats the previous night. “I was out drinking with them. They told me they were going to take the house from me,” Fiddes was alleged to have said.

His niece replied: - “I don’t think they can do that.” Fiddes said: - “They can’t. I’ve shot both of them. I’m going down to the police station.”

Mr. Macaulay said neighbours heard two noises at about 3 a.m. but had thought of them as merely the aftermath of the party. “The gun that was involved was in the house at the party and was readily visible to everyone.” It had been shown to guests.

In reply to Lord Hunter, Mr. Macaulay said he had accepted the pleas of culpable homicide on the grounds of diminished responsibility and with regard to Fiddes’s background and history.

Lord Hunter said he would not want to proceed to sentencing if there was any possibility that further information might be available to the Court and continued the case to a sitting of the High Court in Edinburgh on November 4.
